Throughout this website, the terms “we”, “us” and “our” refer to Afterfan.

These Terms of Service apply to your use of our website and to purchases made through Afterfan.

By accessing our website, placing an order or otherwise using our services, you agree to these Terms of Service, together with our:

• Privacy Policy;
• Shipping Policy;
• Return & Refund Policy; and
• any other policies or terms made available on our website.

If you do not agree to these terms, you should not use the website or place an order.

Nothing in these Terms of Service excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Online Store Terms

You must only use our website for lawful purposes.

By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the payment method provided.

You must not use our products, website or services for any unlawful or fraudulent purpose.

You must not attempt to interfere with the operation, security or functionality of our website.

2. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, colours, dimensions and other information displayed on our website are accurate.

However, minor differences may occur due to factors such as:

• screen and display settings;
• lighting in product photography;
• manufacturing tolerances; and
• reasonable product updates or improvements.

Any material change to the product ordered will not be substituted without appropriate disclosure or where doing so would be inconsistent with your rights under applicable law.

3. Product Performance

Product performance may vary depending on how and where a product is used.

Factors such as fan speed, ambient temperature, charging conditions, battery condition, airflow restrictions and simultaneous use of other functions may affect battery runtime and performance.

Where we publish figures such as airflow speed, battery capacity or expected runtime, those figures should be read together with any qualifications or testing conditions stated on the relevant product page.

Nothing in this section limits our obligations in relation to product descriptions, representations or consumer guarantees.

4. Prices

Prices displayed on our Australian website are in Australian dollars (AUD) unless otherwise stated.

Where applicable, displayed prices include GST.

We may change prices, promotions or discounts from time to time. A change in price will not affect an order that we have already accepted, except where required to correct an obvious error and permitted by law.

Any delivery charges or other applicable charges will be shown before you complete your purchase.

5. Orders

Submitting an order does not necessarily mean that the order has been accepted.

After receiving your order, we may send an order confirmation or acknowledgement to the email address provided.

An order may be declined or cancelled where reasonably necessary, including where:

• payment cannot be authorised;
• an item is unavailable;
• incorrect pricing or product information has been displayed;
• we reasonably suspect fraudulent activity; or
• we are unable to fulfil the order.

If we cancel an order after payment has been taken and no goods are supplied, we will refund the applicable amount.

We will not cancel an accepted order simply because the price later changes.

Payments may be processed by third-party payment providers made available through our website.

Your use of a third-party payment service may also be subject to that provider’s terms and privacy practices.

We do not guarantee that every payment method will be available at all times.

8. Discounts and Promotions

Discount codes, promotional offers and other promotions may be subject to additional terms stated at the time of the promotion.

Unless otherwise stated:

• promotions cannot be exchanged for cash;
• discount codes may have expiry dates;
• some products may be excluded; and
• multiple promotional offers may not be able to be combined.

We may refuse use of a promotional offer where it has been obtained or used fraudulently or contrary to the clearly disclosed conditions of the promotion.

9. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy.

Estimated delivery timeframes are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Delivery can be affected by circumstances outside our reasonable control, including carrier delays, severe weather, public holidays, remote delivery locations and other transportation disruptions.

Tracking information will be provided where available.

If tracking has not progressed for an extended period, please contact us so we can investigate the shipment.

10. Risk and Delivery

Responsibility for the goods passes to you when the order is delivered to the delivery address provided, subject to applicable law.

Please ensure that the delivery address supplied at checkout is complete and accurate.

If an order is returned to us because an incorrect or incomplete address was supplied, additional delivery costs may apply before the order can be resent, except where the issue was caused by us or the carrier.

11. Returns and Refunds

Returns, refunds and exchanges are governed by our Return & Refund Policy.

Afterfan currently offers a voluntary 60-Day Money-Back Guarantee, subject to the conditions set out in that policy.

This voluntary guarantee is provided in addition to any rights you may have under the Australian Consumer Law.

12. 12-Month Product Warranty

Eligible Afterfan products are backed by our voluntary 12-month product warranty, subject to the terms set out in our Return & Refund Policy and any applicable warranty information supplied with the product.

Our voluntary warranty does not replace or limit consumer guarantees under Australian law.

Consumer guarantees apply automatically and may continue for a reasonable period depending on the product, regardless of the duration of a voluntary warranty. ACCC

13. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.

You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms of Service, our 60-Day Money-Back Guarantee or our 12-month product warranty excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.

Australian businesses cannot contract out of these statutory consumer guarantees. ACCC

14. Appropriate Product Use

Afterfan products should be used in accordance with:

• supplied instructions;
• product warnings;
• workplace procedures;
• applicable safety requirements; and
• the intended purpose of the product.

Take appropriate care when using wearable products around machinery, moving equipment or other environments where loose clothing, straps or accessories may create a hazard.

Do not expose a product to water, heat, impact or other environmental conditions beyond any specifications or ratings published for that product.

15. Charging and Batteries

Use suitable and compatible charging equipment when charging Afterfan products.

Do not use charging equipment that is visibly damaged or unsuitable for the product.

Rechargeable battery performance will naturally vary with use, charging conditions, temperature and age.

Always follow any charging and battery instructions provided with the product.

16. Third-Party Services

Our website may use or link to services operated by third parties, including payment processors, delivery providers, review platforms or other online services.

We are not responsible for the operation or content of independent third-party websites or services that we do not control.

Where you choose to use a third-party service, that provider’s own terms and privacy policies may apply.

17. Links to Other Websites

Our website may contain links to websites operated by other organisations.

These links may be provided for convenience or information.

The presence of a link does not necessarily mean that we endorse or control the linked website, its products, services or content.

18. Reviews and User Content

If you submit a product review, photograph, testimonial or other content to us, you confirm that:

We aim to keep our website available and operating correctly but cannot guarantee uninterrupted access at all times.
